The Website is owned and operated by NEW DIGITAL SOLUTIONS LLC (the “Company” or “we”).

These Terms of Use (“Terms”) constitute a legally binding agreement that governs your use of the Website and is entered into between you (“you” or the “User”) and the Company. Please do not use the Website if you do not agree to these Terms.

The collection and use of personal data in connection with your use of the Website is carried out in accordance with our Privacy Policy.

Entire Agreement

These Terms, along with any applicable policies published on the Website,  including the Privacy Policy and Cookie Policy, constitute the entire legally binding agreement between you and the Company governing your use of the Website.

By using the Website, you hereby represent and confirm that:

  • you have read, understood, and agreed to be legally bound by these Terms in full;
  • if you are an individual, you have full legal capacity, meaning you have reached the age of majority and are not otherwise restricted;
  • if you act on behalf of a corporation, governmental organization or other legal entity, you have the right, power, and authority to enter into these Terms on behalf of such an entity and bind it to these Terms;
  • under the laws of your jurisdiction, you are eligible to enter into this Agreement and are not subject to any restrictions on using the Website.

Website

The Website contains information about the Company’s activities, our values and approach, current job openings, the application process, and other materials related to the Company and its projects.

How to Join the Team

On the Website, you can view open positions at our Company and fill out the form to apply for participation in the recruitment process with the aim of potential employment. The Company is constantly looking for qualified professionals. Therefore, even if there is no suitable vacancy listed at the moment, you can still submit an application, and we will add your data to our internal candidate database. If a relevant opportunity arises, we may reach out to you.

Application Submission

To submit an application, you need to click the “Join” button. The first step involves completing a short form, where the User is asked to provide the following:

  • full name;
  • desired position;
  • one or more contact methods (email address, phone number, Telegram or LinkedIn profile, or upload a CV).

The User may complete the application at this stage by clicking the “Submit Data” button, which allows them to send basic information without proceeding to the next steps.

However, we encourage you to continue with the following stages, as they will help both the Company and you get to know each other better.

Video/Audio Responses

After completing the form, the User will be invited to answer 5 questions. The answers are submitted in the form of a video or audio recording. Recording takes place online and cannot be replayed; however, the User may re-record or delete their responses before submission.

If all responses are deleted, no information is stored. Once saved, the recordings cannot be reviewed by the User. The total response time is limited to 10 minutes, so please take this into account when recording your answers.

To finalize and save your responses, you must click the “Next” button.

Use of Artificial Intelligence (AI)

Please note that the Company may use artificial intelligence (“AI”) technologies for the automated analysis of submitted video or audio responses, including aspects such as emotional tone, intonation, facial expressions, and more.

By submitting video or audio responses, you consent to their processing, including the use of automated tools and AI technologies.

 

Additional Data

As part of our recruitment approach, we also offer Users the option to provide their date, time, and place of birth. This enables us to apply modern self-assessment and team dynamics methodologies, such as Human Design.

These fields are optional, you may skip them by clicking the “Skip” button.

We may also ask you to indicate your expected compensation level.

Please note that all information provided by the User is collected exclusively for internal use by the Company within the recruitment process and is stored in the Company’s internal candidate database.

Content and Intellectual Property

Our Content

All materials on the Website, including but not limited to text, images, design, graphics, information, logos, icons, audio and video files, interfaces, software, trademarks, and trade names (collectively, the “Content”), as well as any copyrights or other intellectual property rights in such Content, are the property of the Company or are used with the permission of the respective rights holders.

You may not use the Content or any of its elements in any way not expressly permitted by these Terms without the prior written consent of the Company or the relevant rights holders.

As part of the recruitment process, Users may create and submit content via the Website, including but not limited to video or audio responses, self-introductions, images, and other information provided in the application form (“User Content”). Such User Content is submitted exclusively for the purpose of participating in the Company’s candidate selection process and is not made publicly available.

The Company does not disclose User Content publicly or share it with third parties unless there is a valid legal basis or separate consent from the User.

By submitting User Content, you represent and warrant that such content:

  • does not contain offensive language or comments related to race, national origin, gender, sexual orientation, or physical conditions;
  • does not include obscene materials (e.g., pornography, scenes of violence, or criminal activity);
  • is not unsolicited or unauthorized advertising, chain letters, spam, mass mailings, or any other form of solicitation;
  • does not promote violence or cruelty, does not contain threats, and does not encourage harm toward any individual or animal;
  • is not fraudulent and does not violate any applicable laws, regulations, or standards;
  • does not infringe on the privacy rights of third parties.

You retain ownership, including intellectual property rights, in your User Content. However, by submitting User Content as part of your application, you automatically grant the Company a limited, non-exclusive, royalty-free, irrevocable, transferable, and sublicensable worldwide license to access, store, process, analyze, copy, and use such content exclusively for the following purposes:

  • evaluating your application and participation in the selection process;
  • internal analytics and improvement of recruitment procedures;
  • internal testing and training of the Company’s HR team.

By submitting your User Content, including video or audio responses, you consent to such use without the need for additional written approval.

The Company will not use your User Content for public or marketing purposes without your separate written consent.

The Website may contain links to websites, services, or resources that are owned or operated by third parties.

The Company does not control the functionality, content, policies, or practices of such third-party websites and services, and is not responsible for their availability, accuracy, completeness, or suitability for any User expectations. Limitation of Liability

We are not liable for any inaccuracies or incompleteness of the information, materials, or content available through the Website, nor for typographical errors or other deficiencies in texts or materials.

We are also not responsible for any User expectations regarding employment, feedback, or outcomes of the selection process. Submitting an application or video does not guarantee an invitation to further stages or any future cooperation with the Company.

Under no circumstances shall the Company, its founders, employees, contractors, or representatives be held liable for:

  • any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data loss, or property damage, arising out of the use of or inability to use the Website;

Termination

Termination by Us

We reserve the right, at any time and at our sole discretion, to modify, suspend, or completely discontinue the Website or specific features (including but not limited to the application form, video tests, newsletters, etc.), with prior notice. You agree that the Company shall not be held liable to you or any third party for such termination.

In the event of actual or suspected violations of these Terms, we may take any lawful actions we deem necessary, including restricting or terminating the User’s access to the Website and/or to any stored data.

We also reserve the right to cooperate with law enforcement authorities or other authorized third parties to investigate such violations, if necessary.

Termination by the User

You may terminate this Agreement with us at any time by ceasing to use the Website and notifying us of your decision, especially if you have previously submitted any personal data or User Content.

In such cases, we will stop processing your data and, where possible, delete it in accordance with our Privacy Policy and applicable laws.

Miscellaneous

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

We may assign our rights and obligations under these Terms to a third party, provided that such assignment does not affect your rights or our obligations under this Agreement.
